Divorce — Frequently Asked Questions
How long does a mutual consent divorce take in Delhi?
The law provides a six-month gap between the first and second motion, and the Supreme Court has held that this period can be waived in suitable cases. Depending on court dates and whether a waiver is granted, most matters conclude in about six to eighteen months.
Do both spouses have to appear in court?
Both parties generally appear to record their statements in a mutual consent divorce. Where one spouse lives abroad or in another city, courts in Delhi may allow appearance through video conferencing.
Where can a divorce petition be filed?
A petition can usually be filed where the marriage was solemnised, where the respondent lives, or where the couple last lived together. In certain cases, a wife can also file where she currently resides.
