Matrimonial Disputes — Frequently Asked Questions
What is the CAW Cell?
The Crime Against Women Cell of Delhi Police often attempts counselling and reconciliation in matrimonial complaints before an FIR is registered. Taking legal advice at this stage can shape the rest of the case.
How is maintenance decided?
Courts consider the income and assets of both parties, reasonable needs, the standard of living during the marriage and existing liabilities. Both sides file affidavits disclosing their assets and income.
Can a cruelty case be quashed after a settlement?
The High Court can quash such proceedings where the parties have genuinely settled their disputes. Whether it will do so depends on the facts of each case.
